Kinetik Terms of Service

1. Purpose and Acceptance
These Terms of Service govern access to and use of the Kinetik platform (the “Platform”), a SaaS (Software as a Service) sports management tool available in mobile (iOS/Android) and web (PWA) formats. The Platform is owned and operated by Ignacio González Valero (“the Owner”).
Downloading, installing, or accessing the Platform, as well as creating a user account, constitutes your full and unconditional acceptance of these Terms. If you do not accept these terms, do not use the Platform.
2. Service Description
Kinetik is a comprehensive sports management platform designed for coaches, technical staff, and players. It enables:
- Roster and team management
- Calendar management (matches, training sessions, events)
- Real-time statistics capture and analysis (during live matches)
- Call list (convocation) and attendance tracking
- Digital tactical boards
- Profile management and physical availability data
- Performance and workload monitoring
- Multi-sport and multi-language support (Spanish, Catalan, English)
The Platform operates online via Internet connection. Although we implement limited offline synchronization, the full experience requires network connectivity.
3. Registration, Users, and Roles
3.1 Registration Requirements
To use the Platform, you must:
- Be at least 14 years old. If you are younger than 14, you require explicit parental/guardian authorization.
- Provide truthful, accurate, and complete information.
- Maintain the confidentiality of your access credentials.
- Immediately notify us of any unauthorized access.
3.2 Roles and Responsibilities
The Platform implements a role-based system with differentiated permissions:
Coach (COACH)
- Team owner (Owner).
- Responsible for subscription payment (license).
- Full permissions: create/edit/delete teams, rosters, events, and call lists.
- Staff and permissions management.
- Match finalization and statistics capture.
Assistant/Delegate (DELEGATE)
- Technical assistant invited by the coach.
- Limited permissions: create/edit events, call lists, and view statistics.
- Cannot delete data, manage licenses, or administer staff.
Player (PLAYER)
- User invited to the team (via QR code or invitation).
- Read-only access to their profile, calendar, and call lists.
- Can confirm/decline call lists.
- Limited access to statistics (based on team permissions).
The Coach is responsible for ensuring all players under 14 years old invited to their team have prior parental authorization.
4. Licenses and Subscription Model
4.1 License Types
The Platform operates under a per-team license model. Three types exist:
Trial License (TRIAL)
- Duration: 14 days from first account creation.
- Cost: Free.
- Features: Full read and write access during the period.
- Limit: Upon expiry, the team enters read-only mode until acquiring a license.
Promotional License (PROMO)
- Available during open beta period (until July 31, 2027).
- Duration: Valid until July 31, 2027 at 23:59:59 UTC.
- Cost: Free.
- Features: Full access.
- Note: Applicable only during beta phase. Will be automatically retired at period end.
Premium License (PREMIUM)
- Plans: Annual (auto-renewable every 12 months) or Monthly (auto-renewable every month). The user chooses the plan when subscribing.
- Cost: Per current rates on Apple App Store, Google Play Store, or our website for each plan.
- Payment processing: Handled by Apple, Google, or RevenueCat depending on platform.
- Features: Full access without restrictions.
4.2 Payment Model
- Per-Team Payment: Each team requires its own license.
- One User, Multiple Teams: A user can create or manage multiple teams, requiring one license per team.
- Team and licence ownership: The team owner (Team Owner) is the Coach or, where applicable, the club or responsible entity that has purchased and sustains the licence. That natural or legal person is the one who subscribes, who maintains the commercial relationship with Kinetik and who makes decisions about the team (staff, invitations, cancellation).
- Payment Responsibility: The owner indicated above is responsible for maintaining an active license. In case of non-payment, the team enters read-only mode until the situation is regularised.
- Processing: Payments are processed by third parties (Apple, Google, RevenueCat) under their own terms and privacy policies.
4.3 Renewal and Cancellation
- Auto-Renewal: Premium licenses auto-renew 24 hours before expiration.
- Cancellation: You may cancel your subscription at any time through the payment platform (App Store, Play Store, or RevenueCat).
- License Transfer: You may change or reassign licenses between teams within the application.
4.4 Refunds and Returns
Payments are processed directly by Apple, Google, or RevenueCat. Any refund requests must be submitted through these platforms’ support services, subject to their refund policies. The Owner does not process refunds directly.
5. Device Permissions
To provide the service, the Platform requests the following device permissions. All are optional except those strictly required for basic functionality.
5.1 Camera
- Current use: Scan QR codes to link players/staff to a team (invitation process).
- When requested: When opening the scanner screen for the first time.
- Alternative: You can invite manually without using the camera if you deny the permission.
- NOT used for: Recording video, automatically capturing images, or processing content beyond the QR code.
5.2 Gallery / Photos
- Use: Upload profile photo for the user or roster players.
- When requested: When tapping “change photo” on a profile.
- Processing: Images are resized locally (500x500 avatar / 200x200 thumbnail) before being uploaded to our S3 server.
5.3 Push Notifications
- Current status: The Platform does NOT send push notifications. We do not request this permission.
- In the future: When implemented (for call lists, event changes, etc.), this clause and the Privacy Policy will be updated, and explicit consent will be requested.
5.4 Location
- Current status: The Platform does NOT access the device’s GPS location. Event locations are entered manually by the Coach (free text).
- In the future: If implemented (e.g., for match maps), this clause will be updated.
6. Intellectual Property and Image Rights
6.1 Platform Rights
All code, design, logos, architecture, interfaces, and functionality of Kinetik are the exclusive intellectual property of Ignacio González Valero. Strictly prohibited:
- Total or partial reproduction without written authorization.
- Reverse engineering, decompilation, or disassembly.
- Modification, adaptation, or creation of derivative works.
- Unauthorized commercial exploitation or resale.
- Use to develop competing products or services.
6.2 User Data Rights
Data you input into the Platform (photos, statistics, player profiles, events, tactical notes) is your intellectual property or that of the entity you represent (club, team).
By using the Platform, you grant Kinetik a limited, non-exclusive, and revocable license to:
- Store and process your data to provide the service.
- Create backups.
- Display data to other team members based on roles and permissions.
- Analyze aggregated data (without personal identification) to improve the service.
You retain the right to request data export or deletion at any time.
6.3 Third-Party Photos and Minors
When a user (typically the Coach) uploads photographs of other players to the roster, especially minors, they declare and warrant that:
- They have explicit written consent from the image rights holder (adult player) or their parents/legal guardians (minors).
- Such consent covers the processing of the image within the Platform (viewing by team members, storage in S3, encryption in transit and at rest).
- They assume legal responsibility in case of third-party claims for unauthorized use of the image.
Parents or legal guardians may request the immediate deletion of the photograph and personal data of the minor by writing to nachogova@hotmail.com. Kinetik will respond to the request within a maximum period of 30 days, in accordance with GDPR.
7. Liability and Limitations
7.1 Service Availability
The Platform is provided “as is” without express warranties of uninterrupted availability. Although we use AWS infrastructure with high availability standards, we do not guarantee:
- 24/7 availability without interruptions.
- Absence of technical failures or errors.
- Compatibility with all devices or browsers.
The Owner is not responsible for losses resulting from service interruptions, except where legally required.
7.2 Data Loss
- We perform periodic backups but are not responsible for data loss resulting from:
- Failures in your personal device.
- Poor network connectivity or incomplete synchronization.
- Misuse, accidental, or unauthorized deletion.
- Force majeure events.
- You may recover deleted data for a limited period (refer to our Privacy Policy).
7.3 Support Tool, Not Professional Advice
The Platform is a management and analysis tool. It does not constitute medical, psychological, nutritional, or professional sports advice. The Owner is not responsible for:
- Sporting or training decisions based on Platform data.
- Medical diagnoses or treatments.
- Injuries, health conditions, or athletic performance.
You are responsible for consulting qualified professionals (doctors, physiotherapists, nutritionists) before making critical health decisions.
7.4 Limitation of Liability
Except where legally required, the Owner’s liability is limited to amounts paid for licenses in the previous 12 months. In no case is the Owner responsible for indirect damages, lost profits, or consequential losses.
8. User Conduct and Prohibitions
Strictly prohibited uses of the Platform include:
- Illegal Content: Hosting, distributing, or promoting content illegal under Spanish or international law.
- Abuse and Harassment: Harassing, intimidating, threatening, or denigrating other users (cyberbullying, discrimination).
- Offensive Content: Posting sexually explicit, violent, hateful, or discriminatory content.
- Security: Introducing viruses, malware, malicious code, or attempting to compromise Platform security.
- Unauthorized Access: Attempting to access others’ accounts, backend systems, or unauthorized data.
- Spam and Manipulation: Using the Platform for mass marketing, spam, or fraud.
- Rights Violation: Reproducing, distributing, or using protected content without authorization.
8.1 Consequences of Non-Compliance
The Owner reserves the right to:
- Suspend or delete your account immediately.
- Revoke access to all teams and data.
- Report illegal activities to competent authorities.
- Seek damages if applicable.
No refund will be issued for account suspension due to terms violation.
9. Privacy and Data Protection
Your data use is governed by our Privacy Policy, which is an integral part of these Terms. Please refer to the Privacy Policy for details about data collection, storage, and usage.
Accepting these Terms means accepting data processing according to the Privacy Policy.
10. Modifications to These Terms
The Owner reserves the right to modify these Terms at any time. Changes will be notified through:
- In-application notifications.
- Email to your registered address.
- Publication on our website.
Continued Platform use after modifications implies acceptance of the new Terms. If you disagree, you may request account deletion.
11. Applicable Law and Dispute Resolution
11.1 Applicable Law
These Terms are governed by Spanish law, including:
- Organic Law 3/2018 (LOPDGDD) — Data Protection.
- Law 34/1988 — Advertising.
- Consumer Protection Laws (where applicable).
11.2 Jurisdiction
For resolving any disputes, controversies, or claims arising from these Terms, both parties submit to the exclusive jurisdiction of the Courts and Tribunals of Terrassa (Barcelona, Spain).
However, if you are a consumer under Spanish or European law, you may bring claims in your home jurisdiction if more favorable to your rights.

12. Final Provisions
If any provision of these Terms is declared invalid, void, or unenforceable, remaining provisions remain in effect.
Failure to exercise any right under these Terms does not constitute waiver of that right.
